In general, the courts consider two aspects of a severance agreement to determine whether it is unacceptable: 24 Generally, severance agreements are valid and are validated by the courts as long as the agreement has been reached on a voluntary basis and the conditions are legal. 4 This is also the case when it appears that the employer gets the best deal. Section 1542 of the Civil Code has been amended to slightly amend the text of the language to be quoted in the publication agreements. The salary, plus all the specific benefits of workers, is referred to as the “redundancy package”. Beyond these requirements, there may be other legal restrictions. For example, there are specific rules for severance agreements that cover the rights to discrimination on the basis of age. A severance contract is often unenforceable if it was signed as a result of false fraudulent statements by the employer. 17 In addition to these rules, an employer must not induce an employee to sign a severance pay contract by fraud, coercion or undue influence. 15 Nor should a severance agreement provide for unacceptable conditions.
